Lunaria Content & Derivative Works Policy

1. Ownership

All content, including but not limited to character designs, likeness, branding, voice, and audiovisual material related to Lunaria, is the exclusive property of the creator.

Use of this content does not grant ownership or transfer of rights under any circumstances.

2. Allowed Use (Fan Content)

You are permitted to create derivative works using Lunaria content under the following conditions:

• The work must be transformative, adding clear creative value (e.g., edits, animations, fanart, commentary).

• The work must remain at a fan or hobby level.

• The work must not be misleading or presented as official.

No prior permission is required if all conditions are met.

3. Monetization Policy

The following is allowed:

• Monetization through platform programs (e.g., YouTube ads, TikTok Creator Program, Twitch revenue).

• Indirect revenue generated from derivative content hosted on third-party platforms.

The following is NOT allowed:

• Selling products, services, or access using Lunaria content outside of the convention & artist alley exception.

• Registering derivative works in Content ID or similar ownership systems

• Using Lunaria content as the primary asset of a business or commercial operation

Convention & Artist Alley Exception

Independent artists are permitted to sell physical derivative works (such as prints, stickers, keychains, and pins) featuring Lunaria under the following conditions:

• Sales must occur in-person at conventions, artist alleys, or similar events

• The creator must be an independent individual or small-scale artist, not a company or mass-production entity

• Products must be fan-made and transformative, not official or misleadingly presented as official merchandise

• Mass production, wholesale distribution, or large-scale online storefront sales are not permitted

• Use of official logos, branding assets, or direct asset reuse (e.g., tracing, ripping) is not allowed

• The creator must clearly indicate the product is unofficial fan-made merchandise

• Credit “Lunaria” as the original character

The creator reserves the right to revoke this permission at any time, especially in cases of:

• Harmful representations

• Brand damage

• Scaling beyond what is considered independent or small-scale

4. Prohibited Content

The following uses are strictly prohibited:

• Content that may harm the image, reputation, or branding of Lunaria

• Content that is defamatory, misleading, or impersonates official material

• Political, religious, or ideological messaging using Lunaria content

• Unauthorized use of Lunaria content in advertisements or promotions

• Use of content in association with illegal, abusive, or exploitative material

5. NSFW / Adult Content

Due to brand positioning, the following applies:

• Suggestive or stylized adult-themed fan content may be tolerated at the creator’s discretion.

• Explicit, degrading, or harmful portrayals are strictly prohibited

• Any content that misrepresents consent, character integrity, or intended persona is not allowed

The creator reserves full authority to determine what is acceptable.

6. Attribution

Where possible, derivative works should include:

• A reference to “Lunaria” as the original source

• A link to official channels when applicable

7. Revocation Rights

Permission to use Lunaria content is revocable at any time.

The creator reserves the right to:

• Request removal of any content

• Issue takedowns without prior notice

• Deny use for any reason deemed appropriate

Failure to comply may result in platform enforcement actions.

8. Platform Compliance

All derivative works must comply with:

• Applicable laws and regulations

• Terms of service of the platform where content is posted

9. No Liability

The creator is not responsible for:

• Any disputes arising from third-party rights

• Damages, claims, or losses related to derivative content usage

10. Changes to Policy

These terms may be updated at any time without prior notice.

Continued use of Lunaria content implies acceptance of the latest version.
